Terms and Conditions

1. General Information

These Terms and Conditions govern your use of the website and participation in all services, events, salons, and retreats (collectively, "Events") hosted by SAWY (Saturday Afternoon With Yuan). By purchasing a ticket, submitting an application, or attending an Event, you agree to be legally bound by these terms.

2. Pricing and Payments

All prices are listed in USD and are inclusive of applicable taxes unless stated otherwise. Full payment is required at the time of booking to secure your reservation. We accept major credit cards, Venmo, Zelle, and WeChat Pay. Detailed payment instructions are provided during the checkout process.

3. Bookings, Applications, and Confirmations

  • Standard Gatherings & Retreats: Bookings are confirmed only upon receipt of full payment. Confirmation and logistical details will be distributed via email or WeChat.

  • Curated Events (Application-Based): To preserve the dynamic and balance of certain cross-cultural dialogues, an application may be required. In such instances, your booking is strictly pending until the application is reviewed and formally approved by SAWY.

4. Cancellations and Refund Policy

  • Standard Policy: Cancellations made at least four (4) days prior to the Event start date are eligible for a full refund.

  • Non-Refundable Period: Cancellations made within four(4) days of the Event are strictly non-refundable.

  • Event-Specific Policies: Certain bespoke retreats or corporate programming may carry distinct cancellation terms, which will be explicitly stated on their respective event pages and supersede this general policy.

5. Modifications by SAWY

SAWY reserves the right to modify, reschedule, or cancel any Event due to unforeseen circumstances, including but not limited to venue issues, facilitator availability, or force majeure. In the event of a cancellation by SAWY, you will be offered a choice between a rescheduled date or a full refund.

6. Assumption of Risk and Liability Waiver

  • Physical and Somatic Activities: Participation in SAWY Events, which may include somatic movement, stretching, or hiking, is entirely voluntary. You assume full responsibility for your own health and physical limitations. We strongly advise consulting a healthcare professional prior to participation if you have preexisting conditions.

  • Information Disclaimer: Any information shared during our Events, particularly regarding Traditional Chinese Medicine (TCM), botanical teas, or wellness practices, is strictly for cultural and educational purposes and does not constitute medical advice.

  • General Waiver: By attending, you release SAWY, its founder, and its affiliates from any liability for personal injury, illness, or property damage sustained during the Event.

7. Culinary Elements and Dietary Restrictions

Culinary offerings, including herbal teas and food pairings, are curated to enhance the cultural experience. SAWY is not a licensed dining establishment. While we strive to source high-quality ingredients, you consume them at your own risk. Guests with severe allergies or strict dietary requirements must notify us in advance. We will make reasonable efforts to accommodate these requests but cannot guarantee a completely allergen-free environment.

8. Intellectual Property

All materials, concepts, curriculum, and frameworks presented at SAWY Events are the exclusive intellectual property of Yuan Zhang and SAWY. They are provided for your personal, non-commercial use only. You may not record, reproduce, distribute, or repurpose any Event content for your own commercial or professional gain without explicit written consent.

9. Media and Photography Release

By attending a SAWY Event, you acknowledge that photography, audio, and video recording may occur. You grant SAWY and Yuan Zhang the irrevocable right and permission to use, publish, and distribute such media—which may include your image, likeness, or voice—for promotional, marketing, and educational purposes across all digital and print platforms without compensation or prior review.

10. Right to Refuse Service and Code of Conduct

SAWY is committed to maintaining a respectful, inclusive, and intellectually rigorous environment. We reserve the absolute right to refuse admission or to eject any person whose behavior is disruptive, disrespectful, or violates the boundaries of the space, without any obligation to provide a refund.

11. Privacy

Your personal data is collected solely for the purposes of event management, payment processing, and direct communication regarding your booking. We do not sell or share your information with third parties without your explicit consent.

12. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your participation in an Event shall be resolved exclusively in the state or federal courts located in Massachusetts.

3. 预订、申请与确认

  • 常规沙龙与静修： 预订仅在收到全额付款后生效。确认信息及活动指南将通过电子邮件或微信发送。

  • 审核制活动： 为确保部分跨文化对话的群体平衡与深度，特定活动可能要求参与者提交申请。在此情况下，您的预订处于待定状态，直至申请经 SAWY 审核并正式通过。

4. 取消与退款政策

  • 常规政策： 在活动开始前至少四 (4) 天提交的取消申请，可获得全额退款。

  • 不可退款期： 距离活动开始不足四 (4) 天的取消申请，概不退款。

  • 特定活动政策： 部分定制静修或企业项目可能适用独立的取消条款。该特定条款将在相应的活动页面明确标示，并优先于本常规政策。

5. 主办方变更权利 因不可预见之情况（包括但不限于场地问题、嘉宾行程变动或不可抗力），SAWY 保留修改、延期或取消活动的权利。若活动由主办方取消，您可选择改期或获得全额退款。

6. 风险承担与免责声明

  • 身体活动风险： 参加 SAWY 活动（可能包含身心律动、拉伸或户外徒步等）全凭自愿。您须对自身的健康状况及身体极限负全责。如有既往病史，强烈建议在参与前咨询专业医疗人员。

  • 信息免责： 活动期间分享的任何信息（尤其是关于中医理念、草药茶饮或养生实践的内容）仅供文化交流与教育目的，绝不构成专业医疗建议。

  • 一般免责： 参与活动即表示您同意免除 SAWY、其创始人及关联方对您在活动期间遭受的任何个人伤害、疾病或财产损失的法律责任。

7. 餐饮与特殊饮食需求

活动中提供的茶饮及佐茶小食旨在丰富文化体验，SAWY 并非常规餐饮服务提供商。尽管我们严格把控食材品质，但食品消费风险由参与者自行承担。如有严重过敏史或严格的饮食限制，请务必提前告知。我们将尽合理努力予以配合，但无法保证提供绝对无过敏原的环境。

8. 知识产权

在 SAWY 活动中展示的所有材料、概念、课程及框架，均为 Yuan Zhang 及 SAWY 的独家知识产权。提供这些内容仅供您个人非商业性使用。未经明确的书面同意，您不得为了自身的商业或职业利益，对活动的任何内容进行录制、复制、分发或重新利用。

9. 影像与媒体发布许可

参加 SAWY 活动即表示您知悉现场可能会进行摄影、录音和录像。您授予 SAWY 及 Yuan Zhang 不可撤销的权利与许可，允许其在所有数字及实体平台（包括但不限于我们的网站、Substack 和社交媒体）上使用、发布和传播包含您肖像、形象或声音的媒体素材，用于宣传、营销及教育目的，且无需支付任何报酬或经您事先审查。

10. 拒绝服务权与行为准则

SAWY 致力于维护一个相互尊重、包容且充满智识的探讨环境。对于任何行为具有破坏性、不尊重他人或侵犯空间边界的人士，我们保留拒绝其入场或要求其离场的绝对权利，且不承担任何退款义务。

11. 隐私保护

您的个人信息仅用于活动管理、支付处理及预订相关的直接沟通。未经您的明确同意，我们绝不会将您的信息出售或分享给第三方。

12. 适用法律与争议解决

本条款与条件受美国马萨诸塞州（Commonwealth of Massachusetts）法律管辖并据其解释，排除冲突法原则的适用。因本条款或您参与活动而产生的任何争议，均应专属交由位于马萨诸塞州的州法院或联邦法院解决。
